Please read these terms carefully.  By making payment you are deemed to have read and accepted the following Terms and Conditions. If you do not agree to these terms, then you may not purchase our courses or use our services.

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of these Terms and Conditions:

  1. Country refers to: South Africa
  2. Company or Owner (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Life House Learning, P.O. Pox 7033, Worcester, Western Cape, South Africa, 6850.
  3. Device means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  4. Feedback means feedback, innovations or suggestions sent by You regarding the attributes, performance or features of our Service.
  5. Service refers to the Website and the courses offered.
  6. Terms and Conditions (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.
  7. Third-party Social Media Service means any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.
  8. Website refers to Life House Learning, accessible from www.lifehouselearning.com
  9. You or User means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. You may only use the courses for your own personal, non-commercial use.  The courses may therefore not be resold or commercially exploited for financial gain by the User.

License of Use:

By accessing the course content, you are deemed to have purchased a valid and legal License of Use. Licenses are non-transferable and may not be shared. The License is valid from the date of purchase and automatically expires at the end of the calendar year in which the course was purchased.  The license is governed by the terms of the License of Use Agreement, the full terms of which can be viewed by following the link www.lifehouselearning.com/license-of-use-agreement

Intellectual Property and Copyright:

The website and course content collectively entitled the “Works”, includes copyright protected Video content, Activity Sheets, Lesson Plans, Text and Images.  No part of the “Works”, may be reproduced or transmitted in any form or by any means, electronic or mechanical, without the written permission of the copyright holder.  All the videos, songs, images, content and graphics used in the Works belong to their respective owners.

The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licencors.

The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Basic Requirements:

Our Videos are streamed via Vimeo and our Activity Sheets and Lesson Plans are downloaded as Adobe PDF’S.  As such the User is required to have access to a computer, the internet and the software to stream videos and open / view documents with Adobe PDF Reader.  The User is also deemed to have sufficient knowledge to operate these devices and software.  The User is responsible for ensuring that their internet services, computer hardware and software are capable of efficiently streaming the online videos and opening the downloadable course material.  The User is deemed to have checked the proper functioning and configuration of their devices and the quality of their video streaming prior to purchase.

The quality of the video streaming will be dependent on the Users internet service provider, and is influenced by many variables including available bandwidth at time of day, geographic location and devices used. If you are using a slower internet connection, attempts to view these videos may be difficult. We will not be held responsible should the Vimeo video streaming service not be available due to technical difficulties. The User is responsible for all costs attached to their internet subscriptions, computer hardware and software.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and their respective licencors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Service will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither the Company nor any of the company’s providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Your Feedback to Us

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions. Upon termination, Your right to use the Service will cease immediately.

Refund Policy:

There are no refunds once a course has been accessed.  Based on the nature of our downloadable Activity Sheets and Lesson Plans and the fact that our videos are streamed, we have no way of knowing whether the course material has been accessed.  As such, payments are typically non-refundable.  There will be no refunds as a result of the User not being able to download the course material or efficiently stream the videos due to inefficiencies of their internet service provider / bandwidth, computer hardware or software.  Please check prior to purchase that you are able to efficiently stream videos and download content.

However, refunds will be considered under the following circumstances: The User did not access any portion of the course and requested a refund in writing within 48hrs of making payment.  Should any refunds be made, there will be a 10% non-refundable administrative fee levied upon reimbursement.

Limitation of Liability:

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You.  Put differently, in the event of a valid claim against Life House Learning, all claims will be limited to an amount no greater than the total fees received from the User.  To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.  As such, You agree to indemnify and hold harmless Life House Learning (including our shareholders, directors, employees and third party service providers) against any claim by any person that relates to or arises from these Terms arising from your registration for and/ or participation in a Service or course.

Disputes Resolution, Legal disputes and Jurisdiction:

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company. Any disputes that cannot be settled directly between the parties to this agreement will be settled by Arbitration, the outcome of which shall be binding.  Arbitration shall be held in Cape Town, South Africa.  This clause shall remain in effect even if this Agreement is terminated for any reason.  This Agreement shall be governed by the laws of South Africa and the jurisdiction of the South African courts.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material We will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at Our sole discretion.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
